Private law is currently characterized by increasing fragmentation and specific legislation. Legislators, legal practitioners and legal scholars seldom focus on the core questions of private law, adversely affecting the structure and consistency of its application. Additionally, many important questions fall outside the scope of such specific legislation. In this context, there is a need for systematization and focus on developing private law concepts and general principles to develop the foundation and unity of private law. Since national elements of private law is increasingly challenged by European and international developments, there is an increasing need to understand the foundations of private law in a European and global legal culture.
